MEDIATION & FACILITATION

The parties to a dispute can benefit from using the services of an experienced, neutral mediator to help them to resolve the dispute. If the parties have not been able to resolve a dispute themselves, a mediator can help them work through their emotional issues, search for common ground, analyze the strengthens and weaknesses of their positions, and evaluate the pros and cons of settlement.

ARBITRATION

The parties to a dispute can hire a neutral arbitrator to make a binding decision regarding their dispute. Arbitration is usually much faster and less expensive than resolving the dispute through litigation in court. The parties may agree to resolve their disputes through arbitration, before a dispute arises, by including an arbitration provision in a contract. The parties may also agree to submit their dispute to arbitration after a dispute arises.

Neither the participants in mediation nor the mediator may be forced to disclose what is said during a mediation session.

Cost

Litigation is costly, not just in attorney’s fees, but also in the time that the parties must devote to the case, and the emotional toll that litigation can take. Resolving a dispute through mediation or arbitration is often a much less costly alternative to litigation.
